DGA Systems – Terms of Use

Effective Date: June 12, 2025

1. Acceptance of Terms

By using any platform, product, or service provided by DGA Systems (“we,” “our,” or “us”), including our CRM, automation workflows, voice systems, and supporting technologies, you (“Customer” or “User”) agree to abide by these Terms of Use. If you do not agree with these terms, do not proceed with any services provided.

2. Scope of Services

DGA Systems offers a fully integrated automation platform, organized into three core product offerings:

● Hero Package (Do It Yourself)

● Engagement Flow (Includes IntelliVA)

● Done For You (Full deployment and branding suite)

3. Customer Responsibilities

Customers agree to:

● Provide accurate information during onboarding

● Use the platform in compliance with applicable laws

● Maintain the security of account credentials

● Monitor communication usage in real-time via the platform dashboard

Deadlines related to project delivery, onboarding, or setup are contingent on when you submit your required intake form. If submitted before 12:00 PM EST, the project will begin the same business day. Submissions received after that time will begin on the next business day.

4. Platform Subscription & Usage Fees

Each product includes a standard $99/month platform subscription. Usage-based communication fees are not included in the setup or subscription fee and are billed separately.

Standard U.S. Usage Rates (subject to change):

● Outbound Phone Calls: $0.0154/min

● Inbound Phone Calls: $0.0094/min

● SMS Messaging: $0.0087/segment

● AI Voice Agent Calls: $0.18/min (prorated)

● Email Delivery: $0.0007/emailProduct Packages & Pla…

Example: For $10 in usage, customers may send ~14,285 emails, or ~1,150 SMS segments, or make ~650 outbound call minutes.

These charges are tracked automatically and billed via the customer’s communication sub-account. Customers are expected to maintain sufficient funds to support usage.

5. Package Descriptions

Hero Package

Do-it-yourself access to branded CRM, funnels, calendar, forms, campaign builders, tagging, and workflow automations. Platform subscription required. No setup fee applies unless additional services are requested.

Engagement Flow

All Hero Package features, plus a 24/7 AI-powered engagement engine and IntelliVA virtual assistant. This package is subject to a setup fee based on the service work required.

Done For You

Includes everything from Hero and Engagement Flow, with a fully custom website, payment system, subscriber management, automations, and launch support. This package is subject to a setup fee based on the complexity and scope of the deployment.

Each package is billed in accordance with its scope and requires confirmation via onboarding agreement.

6. Intellectual Property

All custom-built systems, workflows, websites, automations, and AI agent scripts remain the intellectual property of DGA Systems unless otherwise stated in a signed agreement. You may not resell, duplicate, or reverse-engineer platform configurations or source code.

7. Termination of Access

Your access to the platform may be suspended or terminated if:

● Your account becomes past due

● You violate compliance standards (e.g., SMS regulations)

● You misuse, abuse, or tamper with system functionality

No refunds will be issued for used platform time or labor performed prior to termination.

8. Warranties & Limitations

DGA Systems provides services “as is.” We do not guarantee outcomes such as lead conversion or revenue increases. We are not responsible for:

● Missed calls, failed texts, or delayed responses due to incorrect configuration or third-party disruptions

● Business losses due to misuse or lack of engagement

● Data inaccuracies from incomplete onboarding or CRM misuse

9. Support & Maintenance

Platform users will receive access to setup documentation, email support, and dashboard guides. Those with Engagement Flow and Done For You packages will receive prioritized onboarding, configuration reviews, and testing.

Platform maintenance includes regular updates, API testing, and quality assurance on all automation deployments. User-reported bugs will be addressed promptly during business hours.

10. Modifications to Terms

We reserve the right to update these Terms of Use at any time. Users will be notified of changes and continued use of the platform will constitute acceptance of the new terms.
